The Principle of Correspondence in Criminal Law - Essay Example In criminal law, for an accused person to be found culpable, he or she is obliged to have indeed committed an unlawful act (actus reus) and must have acquired the mental state (mens rea) that propelled him to perform an illegal act. Actus reus is derived from Latin and means â€Å"guilty act† whereas mens rea means â€Å"guilty mind†. Under actus reus, the guilty act referred to could either be the commission or omission of an act that then leads to the violation of existing laws. Consider a case where a person, willingly and knowingly, drives over the speed limit. Here, the act of over speeding is done with total disregard to the existing law. An example of an omission of an act is a case where after adopting a pet, a person fails to care for and feed it thus leading to its demise. The crime in this case arises from the failure to act. In many occasions, a person is required to have had the necessary â€Å"mental state† while committing a crime for him or her to be found guilty of an offence. Often, mens rea refers to the intention to commit a crime. Some crimes, however, are done by unknowingly. Mens rea therefore may refer to other states of mind such as criminal negligence, recklessness or willful blindness. Intention refers to the situation where a person knowingly understands that their actions go against the rule of law and yet they continue with the guilty act. Willful blindness is shown where a person is aware of the possibility of wrongdoing but chooses to pursue with the offense.

Roderigo and Othello Essay The film adaptation of the play Othello by William Shakespeare is a very successful movie tie-in of this piece of classic literature that has been around for decades. Othello is one of Shakespeare’s renowned masterpieces, a love story which ends up as a tragedy. Although it is said that a truly faithful adaptation of a novel or a work in a different medium is not really possible, this movie gives a significant example of an adaptation that gives a fairly faithful reproduction of the play’s storyline. In Act I Scene 1 of the play, the first scene shows Roderigo and Iago arguing about the former’s failure in winning Desdemona’s heart despite Iago receiving a substantial amount from Roderigo, and that now, alas, Othello and Desdemona have gotten married. In the movie, this scene appears later on as the process of intersecting is employed. The first few scenes of the film portray a seemingly illicit tryst which takes place in the night, a court meeting of leaders, and a marriage between a white woman and a black man which is sealed with a kiss. It is only after these sequences are presented that the argument between Iago and Roderigo is shown, that is, after initially establishing the background of why the argument between them came about. Intersecting is also seen in the way Iago and Othello are shown in the film as conniving to kill both Desdemona and Cassio. This is further dramatized when they seal their partnership with a blood compact as illustrated in the movie a few moments before Othello promotes Iago to become his lieutenant. Somehow, this sequence also hints at the possible homosexual tendencies of Iago – as he says the lines: â€Å"I am your own forever† while glancing lovingly at Othello, thereby giving the viewer an idea of the reasons behind Iago’s actions. And then again, towards the end of the film, when Othello has already been disarmed, Cassio is shown secretly handing over a knife to his former master, perhaps giving him a way to escape his inopportune fate. In a way, this just demonstrates that Cassio is indeed a loyal servant of Othello, which the latter realizes quite late, because of the misplaced trust which he establishes with Iago. But then, again, this only gives Othello the resolve to use this weapon to end his life because of what he did to his wife. On the other hand, Act I Scene 2 depicts Iago warning Othello that Brabanzio may propose a divorce, followed by Cassio’s arrival to inform Othello that he is being summoned by the Duke, and then the confrontation scene between Brabanzio and Othello. The movie adaptation resorts to the process of borrowing this time, as these scenes are shortened, and somehow compressed, but still altogether included. The presentation was altered in some way, and yet the essence of this sub-plot was captured in a short screen time of approximately 2 minutes. The same is notable in Act II Scene 1 when a storm supposedly takes place which facilitates the defeat of the Turks. The troops at Cyprus were getting worried because of Othello’s delayed return, and this is highlighted in the play. In the movie, however, these scenes are downplayed, condensed and merely narrated, yet still included in the plot. The apprehensiveness of Desdemona about the delayed return of her husband was not much felt, and yet the beginnings of Iago’s plot to create a tapestry of lies around Cassio and Desdemona’s possible relationship was given more emphasis. This somehow served to draw attention to Othello and Desdemona’s relationship and how from a very ideal union, it soured to become a misfortune. Some other ideas which were borrowed from the original play and incorporated into the movie adaptation were Desdemona’s handkerchief and how it became the object of jealousy, the foreboding song â€Å"Willow† and Othello’s fit of epilepsy. Alternatively, in the last scene of Act I, Brabanzio relates his dilemma to the Duke about his daughter being stolen from him with the use of witchcraft, pointing to Othello as the person who committed this act. Othello is given the chance to explain, which is later on confirmed by Desdemona herself. Thus, Othello’s marriage becomes justified and the explanation narrated by the accused was well-taken by the Duke. After arriving at a resolution to their squabble, Othello is sent to Cyprus on a mission, and Desdemona requests the Duke to allow her to join her husband having been just married. All these sequences are displayed in the movie version and are accurately presented as the film further unfolds, and can easily be described as illustrating fidelity of transformation. Likewise, the scenes pertaining to Iago and the numerous ways by which he portrayed his role of the antagonist in this movie are well-represented. The actor who played the character of Iago was definitely hateful as the traitor friend to Roderigo and Othello, an effective manipulator of people, and an outstanding liar to almost everyone in the cast. Iago definitely abhorred Othello, but in both the play and the film, the underlying reason for this hatred is not delved upon and up until the end, Iago does not apologize for his misdeeds. Although reference to Iago’s suspicions about Othello’s possible involvement with his wife Emilia are left out and never tackled, as well as Iago’s secret lustful desires for Desdemona as cited in the play, the main plot pertaining to Othello and Desdemona’s relationship and the complications that transpire, was truthfully demonstrated and adhered to. Fidelity of transformation is also seen in the way Act II Scene 3 is presented in the movie since all the essential scenes in the play are also recounted from the time Cassio assumes guardship at Cyprus while Othello consummated his marriage to Desdemona, to the brawl with Roderigo, up to the time Cassio is stripped off his rank after engaging in a duel with Governor Montano. Iago’s soliloquys were also retained, further rendering the film as a precise reproduction of this classic literary piece. It is also noticeable that the clown in Act III Scene 1 and the whole of Scene 2 were dropped, but since the main plot about Othello’s love story was still retained, it did not have a significant effect on the main storyline. From Act III Scene 3 up to the last act and scene, the complications of Othello’s jealousy over the imagined relationship of his wife Desdemona with his lieutenant Cassio are gradually revealed and given more weight. It is apparent that the director of the film wanted to focus on the tragedy in the story more than any other of the play’s sub-plots, hence, more than half of the movie’s running time was devoted to the conflict building up – conflict based on the context of â€Å"man against man† and â€Å"man against himself†, up until the story’s climax and gloomy ending. Othello’s jealousy was more imagined than real but it was lamentable because he allowed Iago to exploit and manipulate his thoughts and feelings for Desdemona, which was effectively portrayed and delivered to the viewer in this film. As a whole, the movie version of Othello was a success as an adaptation due to the use of different types of approaches in its presentation. The essential portions of the play were retained, and the translations and transposition of scenes and sequences did not affect the plot so much because the story’s progression was clear and crisp, and the original dialogues retained for the most part. The plot of the movie adhered to Othello and Desdemona’s love story in the play, which was captured as poignantly as it should have been staged before a live audience. With this trend of transforming the play into a more accessible and readily available type of media catering to the mass audience, it will not be surprising to see more such adaptations in the offing. The short story of an American writer regionalist Sarah Orne Jewett, "A White Heron", is one of the works written on this touching American theme. In this story the author presents the conflict by juxtaposing a little country-girl Sylvia, who lives in harmony with nature, to the bird-hunter from a town. She does so through identification of a girl with nature and boys ^ with civilization. While the girl stands for the innoc ent femininity of natural world, who loves and cares about the creatures around, the boys are associated with aggression, danger and warlike elements of civilization. Thus she implies the idea that nature is just like a harmless little girl just exists in peace with every tiny thing around, while civilization, like a young man with a gun, by its utilitarian love for nature senselessly annihilates the artless creation. From the opening lines of the story Sarah Orne Jewett ushers her readers into the magic world of untouched beauty of the "New England wilderness" (WH, p.200): "the woods were already filled with shadows one June evening^" (WH, p.197). The reader is immediately charmed and has no choice but to proceed, to walk further, among the trees, until he meets a little girl, walking by the forest path together with her "plodding" (WH, p.

Rational Choice :: Economics

Rational Choice --------------- In the past century, philosophers and social scientists have given theories of individual and interactive decision making a rigorous foundation. Indeed, contemporary decision and game theory have revolutionized our understanding of rational choice in ways that parallel the concurrent revolution in philosophical logic. Carnegie Mellon's philosophy department is recognized as one of the foremost departments in the world in decision and game theory. Primary research at Carnegie Mellon in decision and game theory focuses on the foundations of Bayesian decision theory, interactive knowledge concepts and their applications in game theory and equilibrium selection in games. Decision theory is motivated to a large extent by the consequentialist, and especially the utilitarian, traditions in moral philosophy. To bring about the best consequences, one must know what they are. From the beginning, both critics and defenders of moral consequentialism raised skeptical doubts about the possibility of ever deriving a satisfactory procedure for rank ordering alternatives so as to identify the best choice. In the special case of utilitarianism, the great 19th century utilitarians John Stuart Mill and Henry Sidgwick themselves thought that an exact calculus of utility that would enable societyÈs members to know precisely how to produce the greatest overall welfare might not be possible. Any proposal for a utilitarian calculus raises two fundamental questions: (1) How are quantities of utility to be ascribed to alternatives in a nonarbitrary way?, and (2) How are likelihoods to be ascribed to alternatives in a nonarbitrary way? A decision theory based upon utility is intimately related to theories of probability, which are needed for the calculation of expected consequences. In 1926, Frank Ramsey presented a monumental essay Truth and Probability, which laid the cornerstones of contemporary decision theory. Ramsey proved a representation theorem that enables one to derive both quantitative utilities and probabilities over alternatives that uniquely cohere with one's qualitative preferences over these alternatives. The work of Ramsey and his successors, most notably Leonard Savage, has resulted in modern Bayesian decision theory, which provides a precise account of how to choose so as to maximize expected utility. This work has also sparked a great flowering of alternative decision theories, some of which generalize Ramsey's and Savage's treatments and some of which constitute alternatives to standard Bayesian decision theory. Game theory considers cases in which decision problems interact. The mathematician John von Neumann and the economist Oskar Morgenstern established game theory as an important branch of social science in 1944 with the publication of their treatise Theory of Games and Economic Behavior. Von Neumann and Morgenstern presented a precise mathematical account of situations in which agents make interdependent decisions. To be sure, von Neumann and Morgenstern had intellectual precursors. Enlightenment Philosophers Essay

John Locke (1632-1704) The British philosopher John Locke was especially known for his liberal, anti-authoritarian theory of the state[->0], his empirical theory of knowledge, his advocacy of religious toleration, and his theory of personal identity. In his own time, he was famous for arguing that the divine right of kings is supported neither by scripture nor by the use of reason. In developing his theory of our duty to obey the state, he attacked the idea that might makes right: Starting from an initial state of nature with no government, police or private property, we humans could discover by careful reasoning that there are natural laws[->1] which suggest that we have natural rights[->2] to our own persons and to our own labor. Eventually we could discover that we should create a social contract[->3] with others, and out of this contract emerges our political obligations and the institution of private. This is how reasoning places limits on the proper use of power by government authorities. Regarding epistemology[->4], Locke disagreed with Descartes[->5]‘ rationalist theory that knowledge is any idea that seems clear and distinct to us. Instead, Locke claimed that knowledge is direct awareness of facts concerning the agreement or disagreement among our ideas. By â€Å"ideas,† he meant mental objects, and by assuming that some of these mental objects represent non-mental objects he inferred that this is why we can have knowledge of a world external to our minds. Although we can know little for certain and must rely on probabilities[->6], he believed it is our God-given obligation to obtain knowledge and not always to acquire our beliefs by accepting the word of authorities[->7] or common superstition. Ideally our beliefs should be held firmly or tentatively depending on whether the evidence is strong or weak. He praised the scientific reasoning of Boyle and Newton as exemplifying this careful formation of beliefs. He said that at birth our mind has no innate ideas; it is blank, a tabula rasa. As our mind gains simple ideas from sensation, it forms complex ideas from these simple ideas by processes of combination, division, generalization and abstraction. Radical for his time, Locke asserted that in order to help children not develop bad habits of thinking, they should be trained to base their beliefs on sound evidence, to learn how to collect this evidence, and to believe less strongly when the evidence is weaker. We all can have knowledge of God[->8]‘s existence by attending to the quality of the evidence available to us, primarily the evidence from miracles[->9]. Our moral obligations, says Locke, are divine commands[->10]. We can learn about those obligations both by God’s revealing them to us and by our natural capacities to discover natural laws. He hoped to find a deductive system[->11] of ethics in analogy to our deductive system of truths of geometry. Regarding personal identity[->12], Locke provided an original argument that our being the same person from one time to another consists neither in our having the same soul nor the same body, but rather the same consciousness. Thomas Hobbes (1588 -1679): Moral and Political Philosophy The English philosopher Thomas Hobbes is best known for his political thought, and deservedly so. His vision of the world is strikingly original and still relevant to contemporary politics. His main concern is the problem of social and political order: how human beings can live together in peace and avoid the danger and fear of civil conflict. He poses stark alternatives: we should give our obedience to an unaccountable sovereign (a person or group empowered to decide every social and political issue). Otherwise what awaits us is a â€Å"state of nature† that closely resembles civil war – a situation of universal insecurity, where all have reason to fear violent death and where rewarding human cooperation is all but impossible. His most famous work is Leviathan, a classic of English prose (1651; a slightly altered Latin edition appeared in 1668). Leviathan expands on the argument of De Cive, mostly in terms of its huge second half that deals with questions of religion. One controversy has dominated interpretations of Hobbes. Does he see human beings as purely self-interested or egoistic[->13]? Several passages support such a reading, leading some to think that his political conclusions can be avoided if we adopt a more realistic picture of human nature. However, most scholars now accept that Hobbes himself had a much more complex view of human motivation. A major theme below will be why the problems he poses cannot be avoided simply by taking a less â€Å"selfish† view of human nature. Hobbes’s moral thought is difficult to disentangle from his politics. On his view, what we ought to do depends greatly on the situation in which we find ourselves. Where political authority is lacking (as in his famous natural condition of mankind[->14]), our fundamental right seems to be to save our skins, by whatever means we think fit. Where political authority exists, our duty seems to be quite straightforward: to obey those in power. But we can usefully separate the ethics from the politics if we follow Hobbes’s own division. For him ethics is concerned with human nature, while political philosophy deals with what happens when human beings interact. Jean-Jacques Rousseau (1712—1778) Jean-Jacques Rousseau was one of the most influential thinkers during the Enlightenment in eighteenth century Europe. His first major philosophical work, A Discourse on the Sciences and Arts, was the winning response to an essay contest conducted by the Academy of Dijon in 1750. In this work, Rousseau argues that the progression of the sciences and arts has caused the corruption of virtue and morality. This discourse won Rousseau fame and recognition, and it laid much of the philosophical groundwork for a second, longer work, The Discourse on the Origin of Inequality. The second discourse did not win the Academy’s prize, but like the first, it was widely read and further solidified Rousseau’s place as a significant intellectual figure. The central claim of the work is that human beings are basically good by nature, but were corrupted by the complex historical events that resulted in present day civil society. Rousseau’s praise of nature is a theme that continues throughout his later works as well, the most significant of which include his comprehensive work on the philosophy of education, the Emile, and his major work on political philosophy, The Social Contract: both published in 1762. These works caused great controversy in France and were immediately banned by Paris authorities. Rousseau fled France and settled in Switzerland, but he continued to find difficulties with authorities and quarrel with friends. The end of Rousseau’s life was marked in large part by his growing paranoia and his continued attempts to justify his life and his work. This is especially evident in his later books, The Confessions, The Reveries of the Solitary Walker, and Rousseau: Judge of Jean-Jacques. Rousseau greatly influenced Immanuel Kant’s work on ethics. His novel Julie or the New Heloise impacted the late eighteenth century’s Romantic Naturalism movement, and his political ide als were championed by leaders of the French Revolution. The Social Contract is, like the Discourse on Political Economy, a work that is more philosophically constructive than either of the first two Discourses. Furthermore, the language used in the first and second Discourses is crafted in such a way as to make them appealing to the public, whereas the tone of the Social Contract is not nearly as eloquent and romantic. Another more obvious difference is that the Social Contract was not nearly as well-received; it was immediately banned by Paris authorities. And although the first two Discourses were, at the time of their publication, very popular, they are not philosophically systematic. The Social Contract, by contrast, is quite systematic and outlines how a government could exist in such a way that it protects the equality and character of its citizens. But although Rousseau’s project is different in scope in the Social Contract than it was in the first two Discourses, it would be a mistake to say that there is no philosophical c onnection between them. For the earlier works discuss the problems in civil society as well as the historical progression that has led to them. The Discourse on the Sciences and Arts claims that society has become such that no emphasis is put on the importance of virtue and morality. The Discourse on the Origin of Inequality traces the history of human beings from the pure state of nature through the institution of a specious social contract that results in present day civil society. The Social Contract does not deny any of these criticisms. In fact, chapter one begins with one of Rousseau’s most famous quotes, which echoes the claims of his earlier works: â€Å"Man was/is born free; and everywhere he is in chains.† (Social Contract, Vol. IV, p. 131). But unlike the first two Discourses, the Social Contract looks forward, and explores the potential for moving from the specious social contract to a legitimate one. Voltaire (1694-1778) Voltaire (real name Franà §ois-Marie Arouet) (1694 – 1778) was a French philosopher and writer of the Age of Enlightenment[->15]. His intelligence, wit and style made him one of France’s greatest writers and philosophers, despite the controversy he attracted. He was an outspoken supporter of social reform (including the defense of civil liberties, freedom of religion and free trade), despite the strict censorship laws and harsh penalties of the period, and made use of his satirical works to criticize Catholic dogma and the French institutions of his day. Along with John Locke[->16], Thomas Hobbes[->17] and Jean-Jacques Rousseau, his works and ideas influenced important thinkers of both the American and French Revolutions. He was a prolific writer, and produced works in almost every literary form (plays, poetry, novels, essays, historical and scientific works, over 21,000 letters and over two thousand books and pamphlets). As his best-known work, Candideis a satirical examination on numerous themes like religion, philosophy, and government, written in the mordant wit and skepticism that Voltaire employs in so many of his works. Translated to numerous languages and adapted to the stage and screen, Voltaire’s opus continues to be widely read over two centuries later. Voltaire certainly gained enough real life experience to garner a cynical attitude towards established dogmatic institutions that repressed the individual during his lifetime. Why does so much evil exist, seeing that everything is formed by a God whom all theists are agreed in naming â€Å"good?† (â€Å"Why?† Philosophical Dictionary, 1764). In his later years Voltaire championed the rights of victims of religious, cultural, and political persecution, sharing many of the same views as Jean Jacques Rousseau[->18] (1712-1778) Charles- de Montesquieu (1689 – 1755)Montesquieu was a French[->19] social commentator and political thinker[->20] who lived during the Enlightenment[->21]. He is famous for his articulation of the theory of separation of powers[->22], taken for granted in modern discussions of government[->23] and implemented in many constitutions[->24] throughout the world. Montesquieu’s most influential work divided French society into three classes (or trias politica, a term he coined): the monarchy[->25], the aristocracy[->26], and the commons[->27]. Montesquieu saw two types of governmental power existing: the sovereign[->28] and the administrative. The administrative powers were the executive[->29], the legislative[->30], and the judicial[->31]. These should be separate from and dependent upon each other so that the influence of any one power would not be able to exceed that of the other two, either singly or in combination. This was a radical idea because it completely eliminated the three Estates[->32] structure of the French Monarchy: the clergy[->33], the aristocracy, and the people at large represented by the Estates-General[->34], thereby erasing the last vestige of a feudalistic[->35] structure.Likewise, there were three main forms of government, each supported by a social â€Å"principle†: monarchies[->36] (free governments headed by a hereditary figure, e.g. king, queen, emperor), which rely on the principle of honor; republics[->37] (free governments headed by popularly elected leaders), which rely on the principle of virtue; and despotisms[->38] (enslaved governments headed by dictators[->39]), which rely on fear. The free governments are dependent on fragile constitutional arrangements. Montesquieu devotes four chapters of The Spirit of the Laws to a discussion of England, a contemporary free government, where liberty was sustained by a balance of powers. Montesquieu worried that in France the intermediate powers (i.e., the nobility) which moderated the power of the prince were being eroded. These ideas of the control of power were often used in the thinking of Maximilien de Robespierre[->40].Montesquieu was somewhat ahead of his time in advocating major reform of slavery in The Spirit of the Laws[->41]. As part of his advocacy he presented a satirical hypothetical list of arguments for slavery[->42], which has been open to contextomy[->43]. However, like many of his generation, Montesquieu also held a number of views that might today be judged controversial. He firmly accepted the role of a hereditary aristocracy and the value of primogeniture[->44], and while he endorsed the idea that a woman could head a state, he held that she could not be effective as the head of a family.|| Thomas Jefferson (1741-1826) Thomas Jefferson was born in Virginia in 1743 and died on July 4, 1826, t the same day as John[->45] Adams, his life long associate and friend. Their e relationship illustrates the dichotomy that was Thomas Jefferson. He a was the author of the Declaration of Independence, a Secretary of State, a an envoy to France, the third president of the United States, a founder of t the Democratic-Republican party, the anti-federalists party. Baron Charles de Montesquieu’s views on the separation of powers, and t the protection for the rights of the citizenry influenced Jefferson. He believed in the virtues of â€Å"checks and balances† in the formation of the national government, its secured rights and protection for the people. While his views of humanity were more idealistic than those of Madison, they were in agreement for different reasons, for controlling a strong central government. Jefferson, however, opted more for states rights as a means of protection for America’s citizen, an attitude that exemplified his anti-Federalist views. His political thinking was in some respects Newtonian, and he saw social systems as analogous to physical systems. Under this philosophy, love takes the place in the social world that gravity does in the physical world, so that all people are naturally attracted to each other, and it is dependence that corrupts this attraction and results in political problems. Wood argues that, though the phrase â€Å"all men are created equal† was a clichà © in the late 18th century, Jefferson took it further than most. Jefferson held that not only are all men created equal, but they remain equal throughout their lives, equally capable of this attractive love, and that it is their level of dependence that make them unequal in practice. Thus, removing all this corrupting dependence would make all men equal in practice. Thus, Jefferson idealized a future relatively devoid of dependence, in particular those caused by banking or royal influences. Jefferson’s concepts of democracy were rooted in The Enlightenment[->46]. He envisioned democracy an expression of society as a whole, calling for national self-determination, cultural uniformity, and based upon the education of the all the people. The emphasis on uniformity allowed no opportunity for a multiracial republic in which some groups were not fully assimilated into the identical republican values William Blackstone (1723-1780) Blackstone was the great Eighteenth Century English legal scholar whose philosophy and writings were infused with Judeo-Christian principles. The Ten Commandments are at the heart of Blackstone’s philosophy. Blackstone taught that man is created by God and granted fundamental rights by God. Man’s law must be based on God’s law. Our Founding Fathers referred to Blackstone more than to any other English or American authority. Blackstone’s great work, Commentaries on the Laws of England, was basic to the U. S. Constitution. This work has sold more copies in America than in England and was a basic textbook of America’s early lawyers. It was only in the mid-Twentieth Century that American law, being re-written by the U. S. Supreme Court, repudiated Blackstone. An attack on Blackstone is an attack on the U. S. Constitution and our nation’s Judeo-Christian foundations. For instance, international organizations like WHO, UNESCO and UNDP are trying to ameliorate the standard of life across the globe by attempts for eliminating poverty, improving health conditions and providing job opportunities etc. Such steps on the part of globalization provide its positive picture attempting to elevate the nations. On the other hand, the instruments of globalization like multinational companies are exploiting the world labour and have become a major source of collapse of many domestic businesses. Wal-Mart is one of the many examples in this concern. Not only feared by the smaller businesses of Non American countries, the domestic investors suffer the same threat. According to an interview (documented in the article ‘Rediscovering Uncle Sam’ of the book ‘Ambassadors of Peace) with the Mayor of Chestertown, Margo G. Bailey told how she has been fighting the Wal-Mart from entering into the small city of Chestertown for almost a decade because the invasion of Wal-Mart would mean a fiasco for the owners of the small businesses in the locality. This means that if globalization is elevating humans, it is equally abusing them. With the ascending power of globalization in the contemporary world, what becomes the reason of its achievement is three facts. First is the globalization’s role in the amelioration of technology. Twenty first century is considered as the hey day of science, technology and telecommunication. The second reason is the provision of integration of people across borders to get acquainted with the foreign cultures. This has specially marked a boom in tourism industry. Thirdly, the concept of free trade as advocated by globalization has increased the capital flow between nations who are now more interested in global trade without being interfered by the state government. Of many forces of globalization, World Trade Organization is considered its key instrument. S. by becoming the most powerful economy of the world around 2050 as the former has already caught the high brow of the world. Evolution Vs Creationism Debate The question of our origin is probably one of the oldest and most controversial issues in the entire history of science. Is man only a written creation greater than in many religious texts, or is man merely another creature that has developed from nature? One of the main themes for this dilemma is the limitation that exists in our universe to be in a position either to measure one of these theories because of insufficient skills or to validate them. Discussion Scientists have proven in thousands of ways and even convinced the Supreme Court of the United States in 1986 to oppose the teaching of the Bible in the word of science. Not everyone knows that Charles Darwin was meant to be a priest, when he began his studies at Cambridge. The Church of England honored him by burying him near the church of Westminster Abby near Isaac Newton. Many scientists held strong religious beliefs, but they called the Genesis creation story as did Newton in 1681 to Thomas Barnett: As to Moses he described realities in a language artificially adapted to ye sense of ye vulgar. Where natural causes are at hand God uses them as instruments in his works, but I do not think them sufficient for ye creation (Von Sydow, pp. 141-156) Many religions find logic in the premise that science should only explain the limitations of natural laws of creation that God might have to use. Divine intervention cannot be used to explain many scientific theories, including evolution, biology, and physics, although many religions try to use it to justify the inconsistencies between science and religion. Proponents of creationism tend to distort science to make their case, and it is not uncommon to find that they distort even their own beliefs in the process. However, opponents do not all necessarily suggest atheism in evolution either. Many tend to give more flexibility to God in the tools that he used to create as well as the timeline. Scientists have convinced the Supreme Court of the United States in 1986 to oppose the teaching of the Bible as science. In the first trial many religious groups sued the state of Arkansas to ban the theory of scientific creationism because this provision allows the penetration of specific religious doctrines into schools. (Ospovat, pp. 243-6) Judge William Overton wrote in 1982 that this is clearly an effort to introduce the biblical version of creation into the curriculum of the schools. Evidence to establish the definition of scientific creationism is the first 11 chapters of Genesis. The proposed concept is simply acceptance of the fundamentalist version of Genesis. Creationists do not support their beliefs by collecting data, collecting also conflicting scientific data, and ultimately reaching a conclusion. Instead, they take literally what is written in Genesis and try to find a scientific support, whether reasonable to the scientific community or not. The theory of evolution t hrough the cycle of data and theories that were before the scientific community for decades. The arguments presented by creationists are not based on new scientific evidence. (Kent, Carolyn and Daily, pp. 108-12) To best understand the theory of evolution, is is helpful to examine a few examples why the scientific decision making process has led scientists to accept the theory of evolution as opposed to scientific creationism. Scientists are attacking a problem by inventing a number of hypotheses educated guesses. They then test these theories to try to refute their own predictions in several independent observations. After making these observations, the scientists abandon or edit changes in their predictions. Due to the fossils available and science proving their origins and ages, scientists have been able to all but prove their theories regarding evolution. Many new scientific theories were coming to light when evolution was first brought to the forefront of modern thinking, but other scientific theories were also very popular at the time that it passed. For example, Newtons theories about gravity was a significant theory that was gaining round at the same time as evolution, and they possi bly gave each other the ability to flourish. Few scientists believe that the theory of evolution explains everything about our creation. Scientists are constantly searching to further their knowledge and expand on the theories they hold, and evolution does not include the source of the universe. The general theory of evolution claims that all life is closely related and has one common ancestor consisting of multiple or single cells. Many processes, including random differences between animals of the same sex, are also caused by the natural selection of successful variations, new forms and numerous amounts of species evolving over time. (Van Wyhe, pp. 11-13) Creationists do not have clearly formulated models of the theory of creation science but the conventional view can be found from a July 1980 summary of the Journal of the Institute for Creation: Acts and Facts. Acts and facts according to the article presented theory is the same as the literal interpretation of Genesis. It is understood that the Institute for Creation science is very clear in this area: The only way we can discover the true age of the earth is God going to tell us himself. Because he told us very clearly in the Bible that it is several thousand years and nothing more is to be discussed. This is supposed to close the book for all the basic questions about the chronology of the Earth. To support it they use a variety of dating methods and processes based on their level of error. For example, many of them use periodic processes that scientists do not find to be supportive of their beliefs. Similarly, events cannot be used to assess periodic age of the earth. Many places on earth show the progression of earth int he layers of soil that have been deposited over time and created fossils. Creationists explain this evidence away as being placed by God to test their faith. Another indication is the presence of radioactive isotopes in rocks. Each of them shows that the earth was created some time ago. But of the 48 isotopes have a half-life of from one thousand to one hundred million years, many have to stay here in large quantities. In samples isolated for thousands of years, only three of these isotopes remained minimal. Because both layers of calcium and radioactive decay are well-known science, you can use them to date fossils and rocks accurately and consistently. For example, FA Olsen studied the sediments 40 million years along the Newark Basin in New Jersey and found a correlation between the isotopic dating and the dates given by record rainfall. He found a substantial link between variations of precipitation resulting in a layer of crusts movement. He found this with cycles of 12,000, 25,000, 44,000, 100,000 and 400,000 years. (Von Sydow, pp. 141-156) This variation can explain the discrepancies discovered between fossils that have been carbon dated to different periods within the same or nearby layers. Creationists use the discrepancies as evidence that science is incorrect, but science again prevails to prove its worth. Conclusion Science is not always perfect and is always changing based on new discoveries. Theories that were once believed in the absolute truth, have now been shown to be false, whereas, the theories that were ridiculed in the past, are discovered to be true later. So what does this mean for us as human beings to interpret the scientific findings and adapt them to our beliefs? We can only follow our hearts and minds, although all people will never agree on what they believe. The creationist theory is wholeheartedly believed by many, while believers of evolution see it as nonsense. As a believer of evolution, it is hard to understand why creationists continue to hold their beliefs beyond the science that seems to prove evolution, but each person will choose their own beliefs and what they perceive to be fact. Piaget's Theory of Cognitive Development During the 1920s, a biologist named Jean Piaget proposed a theory of cognitive development of children. He caused a new revolution in thinking about how thinking develops. In 1984, Piaget observed that children understand concepts and reason differently at different stages. Piaget stated children's cognitive strategies which are used to solve problems, reflect an interaction BETWEEN THE CHILD'S CURRENT DEVELOPMENTAL STAGE AND experience in the world. Research on cognitive development has provided science educators with constructive information regarding student capacities for meeting science curricular goals. Students which demonstrate concrete operational thinking on Piagetian tasks seem to function only at that level and not at the formal operational level in science. Students which give evidence of formal operational thinking on Piagetian tasks often function at the concrete operational level in science, thus leading researchers to conclude that the majority of adolescents function at the concrete operational level on their understanding of science subject matter. In a study by the National Foundation of subjects in Piaget's Balance Task were rated as being operational with respect to proportional thought development. In addition, seventy-one percent of subjects did not achieve complete understanding of the material studied in a laboratory unit related to chemical solubility. The unit delt with primary ratios and proportions, and when overall physical science achievement was considered, about forty-three percent of the formal operational studies were not able to give simple examples of the problem that were correctly solved on the paper and pencil exam (Inhelder & Piaget, 1958, p. 104). Piaget was primarily concerned with the developmental factors that characterize the changes in the child's explanations of the world around him or her. Piaget's early research showed three parallel lines of development. First, from an initial adualism or confusion of result of the subject's own activity with objective changes to reality to a differentiation between subject and object. Second, from a phenomenological interpretation of the world to one which is based on objective causality. Third, from a unconscious focusing on one's own point of view to a decentration which allocates the subject a place in the world alongside... ...ater extent than at the present. Science teachers who are chiefly concerned about themselves in relation to their teaching role or about their adequacy as a teacher, will be unable to focus on the intellectual capabilities of their students, in spite of the importance and impact which this has been proven to have on student's learning. Animal Abuse Awareness Essay -- Violence Papers

Animal Abuse Awareness â€Å"Ignorance is bliss.† Often times we hear that saying but never truly stop to think of its validity. Think of all the things we as mankind are unaware of. Obviously, there are a number of issues out there that people do not want society to know about. But when it really comes down to it, there isn’t much out there that we wouldn’t be able to learn about, if we really wanted to. Specifically pertaining to controversial or questionable public topics, the information is available to give people the options of learning more about them and forming opinions. This is where the saying â€Å"ignorance is bliss† comes in to play. How much do we as society really want to know? How curious are we to figure out just what animals go through when they are used to test toxins or cut up for coats? These are just two of many scenarios out there that animals suffer through but our society fails to acknowledge. We don’t focus on the negative aspects of th ese issues and others, because we are too dependent on the benefits that come from them. Members of an organization called People for the Ethical Treatment of Animals (PETA) are out to end society’s ignorance in regards to the awareness of animal abuse. Their mission is to inform and convince people of animal rights. Participants hold the belief that animals have the right to be protected from being used for food, experimentation, clothing, and entertainment (PETA). There are a variety of ways the members of PETA try to get their mission and facts across. One major way they go about doing that is through the World Wide Web. PETA’s main website, www.PETA.org contains information about the cruelty of animal abuse in a variety of aspects, like those mentio... ...o end animal abuse would find the sites interesting and informative. In that retrospect, the website does do a good job in giving its intended viewers what they want to read about or see. Despite that, I think like any organization it is in their best interest to grow and expand, and they cannot do this without teaching the unknowledgeable public the facts they need to know. If they put more emphasis in that, perhaps their beliefs can become more widespread across the United States , and around the world. My Ideal Wife

My Ideal Wife, a Descriptive Essay A popular saying goes, â€Å"Marriage involves three rings: the engagement ring, the wedding ring, and the suffering. † If it is commonly felt that marriage is so difficult, why do most people wish to get married? Probably, the instinct to find a mate is inherent in human beings; and I am no exception. Somehow, I believe that there is someone out there who was made especially for me, and, once I find her, we will fall in love, and get married; and only then will I feel complete. So, how will I recognize the right girl for me?What qualities should I be looking for? It is very important to have a person you can always rely on. I want my wife to be this person. She would be tightly connected with my life. I want to wake up by her tender kiss. The first thing I would see would be her smiling face. She would make a breakfast for us. We would call each other from time to time during all day. In the evening I want to have dinner with her, cooked by her, and fall asleep holding my arm s around her. First of all, my future wife should be my best friend. I want to share all my troubles, sorrows and dreams with her.She would never let me down and I could always rely on her. Secondly, I want my wife to be my partner. Everything would be common for us: our children, our house, our money, and duties. And we would have to make important decisions together. They should be sensible and reasonable. Also, we should trust each other. Next, I want to have a good mother for my future children. She should be warm-hearted, gentle, understanding, and sometimes strict with them because a mother plays more important role in bringing up children than a man does.I wish my children were worthy members of modern society. Then, my wife should be an elegant and a good-looking woman. I want her to have smartness and beauty combined. Nowadays it is quite difficult to find a girl who is smart and beautiful at the same time but I will do my best to find her. Character is more important than looks. I cannot deny that I am attracted to good-looking girls, but marrying solely for physical attraction will probably lead to short term pleasure but life-long regret. I have also noticed that beautiful women are often vain and rrogant, which I find most unattractive. One of the main things that I admire in a woman is humility. Such a woman will not boast about her wealth, intelligence or achievements, but, instead appreciate other people's abilities and achievements. She will also readily admit when she has made a mistake. Such a woman would be a joy to live with. Good communication is the key to any solid relationship, most of all, marriage. I would want my future wife to share her thoughts with me. I want to hear her dreams and to share in her struggles.On the other hand, I will also need someone who will be ready to listen to me, and interested to know what is happening in my life. There should be no secrets between us. Life is full of challenges. We can expect to face failu re as well as success; heartache as well as joy; boredom as well as excitement. So, the perfect wife should have a positive attitude and a good sense of humour. She should be witty and say things which make me laugh. The perfect wife would also be one who can see the silver lining behind every cloud, rather than focus on the flaws in every situation.With such a woman, I will be encouraged to look at life in a happier and more positive way. Above all other qualities, the perfect wife will be faithful. She must be someone who really believes in that marriage is made to last â€Å"till death do us part†. She will be totally committed to our relationship, and willing to stay for the long haul, â€Å"in sickness and in health, for better or for worse†; as couples promise in the wedding vows. The perfect wife would not be distracted by other men; not even when I have lost my looks. He would be a â€Å"one man woman†.In return, I will also promise my total loyalty and faithfulness to my future wife. Actually, there are many other qualities that make a woman an ideal wife. However, while it is easy to make lists, finding a woman to live up to them will be very difficult. Furthermore, instead of focusing on my requirements for the perfect wife, I think I should recognize my own imperfections, and set about correcting them. Later in the 90s, they discovered that these arthropods are also carriers responsible for transmission of devastating diseases to mankind. They transmit diseases by feeding on blood from vertebrates, including us humans.As years gone by, many studied: the relationship between the mosquitoes and the diseases they carry; the possible ways of eliminating or preventing the spread by these diseases in areas observed to have a large number of victims. Mosquitoes thrive in moist and relatively warm environments just like what Tropical Countries are. Tropical Countries are home to most number of species of mosquitoes. Our country, the Philippin es, is among the Tropical Countries. Culex, Aedes, and Anopheles are among the most common species of mosquitoes and they carry a vicious disease namely Dengue, Malaria and Yellow Fever which can kill a human.These diseases are common yet deadly diseases to us and the number of victims are still drastically increasing. This leaves some authorities arguing whether mosquitoes are the most dangerous animals to mankind. The average life span of the female mosquito is three to 100 days; the male mosquito will survive 10 to 20 days, but we are not waiting that long for the mosquitoes to die for us to be safe. Neem oil is a natural substance extracted from the seeds of the neem tree (Azadirachta indica), an evergreen native to India.Long used in certain systems of traditional medicine (such as  ayurveda), neem oil is thought to offer a number of benefits when applied to the skin and/or hair. Neem oil contains several fatty acids thought to be beneficial to the skin, such as oleic acid an d linoleic acid. Some proponents also suggest that neem oil can act as a  natural insect repellent. Known as â€Å"azadirachtins,† certain compounds found in neem oil are thought to possess insecticidal properties. (Wong, 2012) In 1994 the the Malaria Research  Center  of Delhi, India tested whether kerosene lamps with 1% Neem oil can protect people from mosquito bites.For that test they burned the lamps in living rooms, and from 6 pm to 6 am caught the mosquitoes sitting on the walls and those attracted to human bait (i. e. volunteers). Neem oil clearly reduced the number of bites on the volunteers and also the number of mosquitoes caught. The protection was greater against anopheles species (the ones that transmit malaria) than against culex. A 1995 study at a field station at the Malaria Research Centre in Ranipur, Hardwar, India tested a mix of 2% neem oil mixed in coconut oil.They showed that applying that mixture to the skin provided significant protection from va rious mosquitoes. It worked best against anophelines, offering 96-100% protection. The malaria transmitting anopheles mosquitoes fall into this group. The numbers for other species were 85% for aedes (carries dengue fever), 61-94% for Culex spp. (can carry West Nile virus) and 35% for Armigeres. In 1996 the Malaria Research  Center  of Delhi, India did another field trial with kerosene lamps in an Indian village. Kerosene lamps with 1% Neem oil were kept burning from dusk to dawn in living rooms.They found that the lamps kept the mosquitoes out of the living rooms and that the malaria incidents of the population dropped dramatically (from about ten cases per thousand people to only one per thousand). Once the lamps were removed, the mosquitoes returned and so did the malaria. As for the safety of this method another 1996 study by the Malaria Research Centre in Delhi, India tested the effects of kerosene lamps with 1% neem oil. Clinical examination of 156 adults and 110 children did not reveal any major adverse effects after one year of exposure to 1% neem oil.This shows that depending upon  what species of mosquito you are dealing with, effectiveness of use varies. For malaria protection Neem oil is fantastic. If you combine the 96-100% protection rate of the home made mosquito repellent with burning Neem oil when sitting outside and wearing sensible clothing you are well protected indeed. A. Statement of the Problem. The number of victims of Malaria, Yellow Fever, and specially Dengue is drastically increasing as PIA or Philippine Information Agency has confirmed. B.Objective of the Study. This study aims to know if the neem oil used as incense added with herbs and other aromatic flowers will be an effective mosquito repellent. The main objective of this study is to know if our Neem Oil Incense along with other herbs will be enough to repel the mosquitoes from our skins and prevent them from biting us and for how long will it be able to repel the mosqui toes. C. Significance of the Study. This study is significant in solving problems relating the diseases brought by mosquitoes.The incense will repel the mosquitoes that carry diseases from the citizens living in areas with a large mosquito population. We will observe if the number of victims in a specific community will decrease once the incense is implied and used. Since our research is aiming if our Neem Oil Incense will be enough to prevent the mosquitoes from biting us, this shall help our community lessen victims of the notorious mosquitoes. METHODOLOGY A. The primary materials needed for this experiment are oil burner and neem oil. Sampaguita and lemon grass will be added to the neem oil to ensure an aromatic scent.The sampaguita and lemon grass does not necessarily affect the properties of neem in repelling the mosquitoes. B. Neem oil  is a  vegetable oil  pressed from the fruits and seeds of the neem (Azadirachta indica), an  evergreen  tree which is  endemic   to the  Indian subcontinent  and has been introduced to many other areas in the tropics. You can buy neem oil in Research Agencies like the International Rice Research Institute located in UPLB, Phil. The sampaguita’s and lemon grass’s juices will be pressed with 1 ml of water until their juices are extracted.The juices of sampaguita and lemon grass will be added to the mixture. This will improve the scent of the neem mixture. The mixture will be placed in the oil burner. We will light the burners for 6-10 hours. There will be 3 cages each having two hours of difference. Cage A’s burner will be lit for 6 hours. Cage B’s burner will be lit for 8 hours. Lastly, Cage C’s burner will be lit for 10 hours. We will observe if the number of hours the burner will be lit has a great effect in the â€Å"repellance† of the neem oil.Since we are aiming on how to repel mosquitoes, we should know first how to attract them in order to know how effective our research will be. We will lure mosquitoes by putting on sweet-smelling lotions or creams. Invest in floral-smelling perfumes. To mosquitoes, these products are sweet-smelling like blood. These fragrances cause the mosquitoes to associate their floral scent for a possible blood supply. And then, as said earlier, we will test each cage with different number of hours.
